Terms of Service

The Perch ("we," "us," the "Service") is a leaderboard where sellers list products alongside a link to their own store or product page, and bid to rank higher within a category. Buyers use the leaderboard to discover products and click through to buy directly from the seller, on the seller's own site. We are not a marketplace: we never take payment for, ship, or otherwise handle the sale of any listed product, and we are not a party to any transaction between a buyer and a seller.

Placing a bid raises a listing's rank. It does not purchase, reserve, or transfer ownership of the listed product, and it does not obligate the seller to sell to the bidder. Being outranked by a higher bid does not cancel or affect any sale a buyer has separately made with a seller. Rank is the only thing money buys on this Service.

Some bids are backed by mock/practice funds and never involve real payment. Where a bid is backed by a real payment (processed by Stripe), your card is authorized, not immediately charged. If your bid is still the highest for that listing once payment processing completes, the authorization is captured and you are charged. If someone else's higher bid wins the race before processing completes, your authorization is canceled and you are never charged — you do not pay for a bid that does not win.

Once captured, a bid is final. We do not offer refunds for a captured bid on the grounds that you were later outbid, changed your mind, or the listed product did not perform as you hoped — rank, at the moment you held it, is what was purchased, and it was delivered.

There is no login. You are identified by an anonymous browser cookie. If you clear your cookies or switch browsers/devices, you lose any association with bids or listings you made previously — we cannot restore that link for you. See our Privacy Policy for how that identifier is used.

You may list anything you have the right to link to and that is legal to sell in the jurisdictions where you offer it. You may not list: illegal goods or services; sexually explicit content; invite/chat links (Discord, Telegram, WhatsApp, and similar) in place of an actual product; listings designed to deceive buyers about what they'll find at the linked URL; or anything that infringes someone else's intellectual property. We may hide or remove a listing that violates this section at our discretion, without a refund of any captured bid tied to it.

We link to third-party sites we do not control and make no representation about the accuracy of any listing, the quality or safety of any linked product, or the reliability of any seller. Buy at your own discretion, from the seller, under whatever terms the seller offers — not from us.

The Service is provided "as is." To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including disputes with a buyer or seller you connected with through it. Our total liability for any claim relating to the Service is limited to the amount, if any, you actually paid us in the 12 months before the claim arose.

We may update these terms as the Service changes. Continuing to use the Service after an update means you accept the revised terms.

These terms are governed by the laws of the United States, without regard to conflict-of-law principles, except where local law requires otherwise.
